The Algorithm That Decided When Grandma Had Recovered Enough

What Is nH Predict?

nH Predict is an AI-based tool developed by NaviHealth, acquired by UnitedHealth Group through its Optum division in 2020. The tool analyzes patient data — diagnoses, age, and functional ability — and produces a prediction of how long a patient will need post-acute care such as a skilled nursing facility stay, inpatient rehabilitation, or home health services.

According to a 2023 investigation by STAT News and subsequent federal lawsuits, UnitedHealthcare set an internal performance target: case managers were expected to keep patient rehabilitation stays within 1% of whatever nH Predict projected. Employees who deviated from the algorithm's recommendations faced disciplinary action, including termination.

A 2024 Senate investigation found that UnitedHealthcare's denial rate for post-acute care claims more than doubled after it began using NaviHealth and nH Predict.
The Error Rate

The lawsuits allege that nH Predict has a 90% error rate. That number comes from looking at how often the algorithm's denial recommendations were reversed when patients or providers appealed. Nine out of ten appealed denials were overturned.

A denial with a 90% reversal rate on appeal is not a quality control system. It is a first line of defense that relies on most people not appealing. Only about 0.2% of members actually file appeals. UnitedHealthcare and Humana both knew this.
What Is Happening in Court

Two class action lawsuits are currently active, both filed in 2023. The UnitedHealth case — Estate of Gene B. Lokken v. UnitedHealth Group — had key claims allowed to move forward in February 2025, including breach of contract and breach of the implied covenant of good faith and fair dealing. The court noted that UnitedHealthcare's own plan documents promised coverage decisions would be made by clinical staff and physicians. The court ordered UnitedHealth to produce internal documents dating back to 2017. The Humana case is proceeding separately with similar claims.

Who Is Affected

nH Predict specifically affects Medicare Advantage patients receiving post-acute care:

Patients in skilled nursing facilities following a hospitalization
Patients in inpatient rehabilitation centers
Patients receiving home health services after discharge
Patients in long-term acute care hospitals
What You Can Do

Request the written denial in full
Ask specifically whether the determination was based on algorithmic recommendations or on a physician review of your case. Under Medicare Advantage rules, coverage decisions must be based on CMS criteria and your plan's coverage terms — not on an algorithm's predictions alone.

If coverage is being terminated while you're in a facility
You have the right to a fast-track appeal. When a skilled nursing facility issues a Notice of Medicare Non-Coverage, you can request an immediate review by a Beneficiary and Family Centered Care Quality Improvement Organization (BFCC-QIO). This can be done the same day. The facility cannot discharge you while the appeal is pending.
You are entitled to know who made the decision and how. "The algorithm said so" is not a sufficient clinical determination. Request it in writing. That request itself creates a paper trail.
